Further to WQ97116, what is the Cabinet Secretary's understanding of the reasoning for limiting the change to England only, and what effects could the policy have on compulsory land purchase in Wales including the feasibility of doing so for the purposes of developing more social housing?

I can confirm that the approach taken reflects the Welsh Government’s Principles on UK legislation in devolved areas which states that subordinate legislation in devolved areas should be enacted by Welsh Ministers. Welsh Ministers have the power under section 33K of the Land Compensation Act 1973 to amend the amounts or percentages for basic and occupier’s loss payments relating to land in Wales. The clause ensures that compensation awarded to those whose land or property is subject to compulsory purchase more accurately mirrors the disruption and inconvenience they experience.

It would therefore not directly impact on the delivery of social housing as the level of compensation resulting from compulsory purchase would remain the same. It will be for a future Government to consider if such changes are needed for Wales.
