Will the Minister confirm whether a level 3 mental health practitioner, registered with Social Care Wales as a social worker is authorised to take a primary mental health care assessment under the Mental Health (Wales) Measure 2010 Codes of Practice and the Mental Health (Wales) Regulations 2012?

The Mental Health (Wales) Measure 2010 provides that local mental health partners must ensure that a primary mental health assessment is carried out by an eligible individual under regulations made under section 47.

The professional requirements for eligibility are set out in the Schedule to the 2012 Regulations. These requirements include a qualified social worker registered with Social Care Wales. However, the individual also has to demonstrate that they have appropriate experience, skills or training and this would be a decision for the local mental health partner.

Level 3 mental health practitioner is not a profession listed in the above schedule, and therefore it would be the profession of social worker and registration with Social Care Wales that would provide the individual with eligibility in this case.
