Further to the publication of the Clean Air (Wales) Bill White Paper, what evidence does the Minister have that changes in relation to smoke control orders could address the enforcement problems experienced by local authorities?
Local Authorities across Wales have provided evidence highlighting the burden of proof is an obstacle to effective smoke control enforcement. In the White Paper we are proposing to change from criminal to civil enforcement sanctions to reduce the burden of proof, making enforcement easier. This will better enable Local Authorities to issue improvement notices with advice on compliance. Should these measures fail to have effect, Local Authorities will be empowered to issue Fixed Penalty Notices.
