Will the Counsel General confirm that the total sum disclosed in Plenary on 21 May 2019 relating to the Welsh Government’s legal services department into the judicial review of the coroner’s decisions in respect of the inquest into the death of Carl Sargeant covered both phases of the judicial review?

The sum of £18,732.18, as confirmed during plenary on 21 May 2019, was the total sum spent by the Welsh Government in relation to the Judicial Review proceedings of the Coroner’s decision not to admit certain pieces of evidence into the inquest.

A written application for permission to proceed with Judicial Review was initially lodged and permission was refused on the papers. An oral application to proceed with Judicial Review was made at Court on the 5th March 2019 and permission to proceed was granted. The substantive Judicial Review hearing took place on the 9th May 2019 at which time the Judicial Review was dismissed.

Counsel was instructed to draft the initial Judicial Review application and to make submissions at the oral hearing on the 5th March and 9th May 2019. Counsel’s Fees represented £12,314.60 (£10,284.67 plus VAT). In order to make the application, it was necessary to obtain a transcript of the decision under challenge which cost £5,081.58. The Court Fee for lodging the Judicial Review was £1,309.00.

No other payments were made in respect of the Judicial Review.
