Does the Minister have any plans to review the rules relating to tree protection orders in Wales?

Answered by Minister for Housing and Local Government | Answered on 14/01/2019

Legislation relating to Tree Preservation Orders (TPOs) has recently been the subject of review by the Law Commission for England and Wales as part of their wider review of Planning Law in Wales. Informed by the responses to two consultation exercises and their comprehensive review of the legislation and case law, the Law Commission finalised their recommendations for reform with the publication of their Planning Law in Wales: Final Report on 3 December 2018. Detailed consideration is now being given to all the recommendations, including those relating to the legislation on TPOs. In accordance with the protocol agreed with the Law Commission, a detailed Government response to the report will be provided within 12 months of its publication.
